Driving DUI and Causing Accident

My alcoholic husband is driving DUI. If he causes a wreck and possibly kills someone, can we be sued personally? Am contemplating divorce to protect the assets I have worked for 35 years. AnswerHi Patty You better get a legal opinion to confirm, but I'm pretty sure you can. From the expertlaw.com website: "If you injure or kill somebody, you will also most likely be sued by that person or his family. You should note that damages you cause to people as a result of drunkenness are not dischargeable in bankruptcy. You should also be aware that some states will not allow you to have a driver's license until you satisfy (i.e., pay off) a judgment against you, for injuries you cause in an automobile accident." So if your assets are in joint names, then you of course are also at risk. What your husband is doing is clearly irresponsible and highly dangerous. He clearly needs help and you may want to consider performing an intervention to ensure he gets it. All the Best |
